By completing the registration form, the selected date will be reserved according to the deposit made and the plan registered in the system. These are the two essential conditions required to guarantee the photography service on the Wedding or Event date indicated below.
Under no circumstances will the deposit be refunded, as it guarantees the reservation of the date for the contracted service. Once the deposit is received, the date is blocked exclusively for the Client; therefore, it is non-refundable under any circumstance.
In the event of cancellation or rescheduling of the wedding or event by the Client, such change may be made at no cost if notice is given at least ninety (90) calendar days prior to the scheduled date stated in this Agreement.
If notice is given less than ninety (90) days prior to the event, a penalty fee of $4,500,000 COP will apply and will not be covered by the initial deposit.
For rescheduling (applicable only once), the new date will be subject to the Company’s availability, and the event may be covered by any photographer on the Company’s team. If the Client does not accept this condition, no downgrade of the contracted plan will apply, and the initial deposit will not be refunded.
By the Provider:
In the event that the Provider, due to force majeure or duly justified personal circumstances, is unable to perform the services on the agreed date, the Provider agrees to notify the Client at least ninety (90) calendar days in advance.
In such case, the Client may choose between the following options:
Service reassignment to a photographer from the Provider’s team, with a level and style aligned with the Provider’s work, maintaining the conditions of this Agreement. The Provider will oversee the process and final editing.
Contract cancellation, with a full refund of all amounts paid up to that date, with no additional penalties for either party.
If the Provider’s notice is given less than ninety (90) days prior to the event date, the Provider shall refund all payments received and will assist the Client in finding a replacement photographer of comparable level.
If, due to extraordinary circumstances such as quarantine measures, COVID-19, or natural disasters, the event cannot take place, the date may be rescheduled without penalty, provided the change is notified at least ninety (90) calendar days in advance of the original wedding date.
For plans with more than seven (7) hours of coverage, the contracting Client or couple must provide lunch, snacks, hydration, and dinner for the photography team (between two (2) and six (6) people, depending on the selected plan).
For hourly photography plans (this does not apply to full-coverage plans such as Unforgettable, Premium, and Digital), the contracted hours must be continuous.
Example: If the event starts at 3:00 p.m. and three (3) hours were contracted, coverage will end at 6:00 p.m.
For full-coverage plans, the maximum continuous coverage time is:
• 11 hours for Unforgettable +
• 10 hours for Unforgettable
• 9 hours for Premium
It is the Client’s responsibility to schedule the date for the Pre-Wedding, Post-Wedding, or Pre-Quinceañera session at least sixty (60) calendar days in advance and notify the photographer to reserve and secure the date. (Sessions are not conducted on Saturdays.)
For plans that include Pre-Wedding or Post-Wedding sessions, the Client must cover the photographer’s travel and necessary expenses, including transportation to the location, lodging, meals, tolls, fuel, hotel fees, park entrance fees, and any other related costs. Rates start at approximately $65 USD.
The duration of the Pre-Wedding or Post-Wedding session is one (1) to two (2) hours, depending on the selected plan. These sessions are not conducted on Saturdays or Sundays.
Final delivery of the photographs will be made within fifteen (15) business days, counted from the next business day following the session.
Exception: If the Pre-Wedding session is not performed, no discount or reduction shall apply, as the session is considered a complimentary benefit included in the Unforgettable and Premium plans. This time may not be exchanged for any other wedding-related activity, such as a Welcome Party or Rehearsal Dinner.
Full payment for the contracted service must be completed in advance, no later than one (1) week before the wedding or event.
For the Unforgettable and Premium plans (10 to 11 hours), transportation for the team is included for all locations on the wedding day, including preparations, ceremony, reception, and any additional necessary locations.
Digital Photos: The number of delivered digital photographs corresponds to the selected package, and all photographs are provided fully retouched (including contrast, white balance, shadows, details, color enhancement, and sharpening) in high resolution, as displayed on the website www.iandresh.com.co. This does not include advanced Photoshop editing, digital manipulation, or photo composites.
Digital photo delivery will be completed within twenty (20) business days, and within five (5) business days for the UNFORGETTABLE+ plan, counted from the next business day following the event.
During high-demand months (October, December, January, March, and June), delivery may take up to twenty-five (25) business days.
Additionally, the Company will take a one-week recess during the first week of each calendar year, which shall not be counted toward the delivery timeframe.
The Photo Book will be delivered after the contracting Client or couple selects the photographs they wish to print through the application provided by the photographer.
The photographer will then prepare and send a digital design, which must be approved by the Client before printing. Once approved, the Photo Book will be delivered within fifteen (15) business days from the approval date.
If the photo selection for the book is submitted more than ninety (90) days after the wedding and extends into a new calendar year, the Client must cover an additional cost resulting from annual increases in printing production costs based on the country’s Consumer Price Index (CPI) and any additional market adjustments.
Example: If the wedding takes place in June 2021 and the photo selection is submitted in February 2022, the Client must cover the applicable adjustment fee.
The digital design process may take between thirty (30) and ninety (90) business days if the selection is submitted more than ninety (90) days after the wedding.
A draft of the Photo Book design will always be provided for approval before printing. Once approved, no changes to the editing or design may be made.
The application (APP) or website used for digital photo delivery will have limited access. Clients may access the gallery as many times as they wish during the following periods:
• 30 days for hourly plans
• 180 days for Premium and Digital plans
• 365 days for the UNFORGETTABLE plan
Backup: Photographs will be stored on our servers for three hundred sixty-five (365) days. After this period, they will be removed from the servers and archived in cloud storage. If a backup of photographs or videos is requested after this period, an additional fee will apply for retrieval and download.
The contracting Client or couple will have up to seven (7) calendar days after receiving their products (Photo Book, USB drives, boxes, videos, or photographs) to request warranty claims for damages, editing changes, missing photographs, or defective products.
After this period, the original RAW/unedited files will be deleted, and no further editing, color adjustments, or claims regarding missing photographs may be processed.
If the service is contracted outside Colombia, delivery of physical products (Photo Book, USB drive, or any other item) will be shipped to the Client’s address. Shipping and delivery costs must be covered by the Client. This condition also applies to deliveries within Colombia.
If, due to force majeure circumstances such as an accident, serious illness, or a family emergency involving AH PHOTOGRAPHY, the lead photographer, Andrés Hernández, is unable to attend the event and the situation is duly verified, a photography team from our staff will be assigned to cover the event.
For photography plans contracted by the hour (equal to or less than seven (7) hours), the Company will assign an available photographer from its staff to cover the event or wedding. This shall not constitute valid grounds for cancellation.
For plans that include a second photographer, such coverage applies only on the wedding day and specifically during the groom’s preparations, ceremony, welcome cocktail, and protocol moments (toasts, speeches, and first dance).
The photography service contracted with AH PHOTOGRAPHY guarantees the quality of the photographs and videos showcased on the website or social media platforms located at www.iandresh.com.co and Instagram @andresh_ph.
By contracting this service, the Client accepts the style, tones, colors, creativity (artistic creation process), and editing applied to each delivered photograph.
The Client may acquire the digital files in RAW format or the complete set of high-quality JPG photographs taken during the event for an additional fee of approximately $250 USD.
This request must be made expressly no later than ten (10) calendar days after the wedding date or, alternatively, before the event.
The indicated fee does not include the storage device (hard drive or USB drive), which must be provided by the Client or purchased at an additional cost.
The contracting Client authorizes the photography company with which this Agreement is executed to use the photographs solely and exclusively for promotional purposes, including competitions, rankings, websites, social media, printed advertising, press publications, magazines, business cards, and professional exhibitions.
The commercialization of these photographs is expressly prohibited without the prior, reliable, and written authorization of the contracting Client.
All works and photographs produced by AH PHOTOGRAPHY are protected under Law 23 of 1982 and CAN Decision 351, which safeguard the moral and economic rights associated with artistic works and photographs.
Social events held before or after the wedding, such as a Welcome Party, Rehearsal Dinner, or similar celebrations, may be covered by any member of the Company’s team, depending on availability.
Coverage for these events must be requested at least ninety (90) days in advance and will be subject to availability and possible additional costs depending on the amount of coverage time required.
For weddings held outside Colombia, including destinations such as the United States, Mexico, Peru, Costa Rica, Panama, Europe, or any other international destination, once the photography team has arrived in the destination country, the contracting Client must assume all local transportation costs.
These costs include transfers between airports, hotels, event locations, additional contracted sessions, and any other transportation required during the contracted service days.
These expenses do not include international airfare but do guarantee the team’s internal mobility during their stay to fulfill the obligations agreed upon in this Agreement.
